Terms of Use

These Terms of Use ("Terms") govern your use of the Piuma mobile application ("Piuma", the "App"), operated by Golden Genius LTD ("we", "us", "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The Service

Piuma is a language-learning application that delivers vocabulary words and example sentences, with audio pronunciation, through your device and push notifications. The App offers a limited free experience and premium features available via subscription.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the App. By using Piuma, you represent that you meet this requirement.

3. Subscriptions, Free Trial, and Billing

Piuma offers auto-renewing subscriptions that unlock premium features. The following terms apply:

• Plans and pricing: Piuma offers a weekly plan and a yearly plan. Current prices are shown in the App before you purchase and may vary by region. Prices are charged in your local currency where available.
• Free trial: Where offered, a free trial gives you access to premium features for a limited period. If you do not cancel at least 24 hours before the trial ends, the subscription will automatically begin and your payment method will be charged.
• Auto-renewal: Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Payment: Payment is charged to your Apple ID account at confirmation of purchase. All purchases are processed by Apple and are subject to Apple's terms.
• Managing and cancelling: You can manage or cancel your subscription in your device's Settings → your Apple ID → Subscriptions. Deleting the App does not cancel your subscription.
• Refunds: Purchases are processed by Apple, and refund requests are handled by Apple in accordance with its policies. We do not directly process refunds.

4. Free Features

Certain features of the App are available without a subscription. We may change which features are free or premium at any time.

5. Acceptable Use

You agree not to:

• Copy, modify, distribute, sell, or lease any part of the App or its content;
• Reverse engineer or attempt to extract the source code of the App, except where permitted by law;
• Use the App for any unlawful purpose or in any way that could damage or impair the service.

6. Intellectual Property

The App and all of its content — including text, vocabulary sets, example sentences, audio recordings, design, graphics, the Piuma name, and the feather logo — are owned by Golden Genius LTD or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes.

7. Educational Content Disclaimer

Piuma is an educational aid intended to support language learning. We make reasonable efforts to ensure translations and audio are accurate, but we do not guarantee that all content is free from errors, and we do not guarantee any particular learning outcome or level of fluency.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the fullest extent permitted by law, Golden Genius LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from your use of or inability to use the App. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Third-Party Services

The App relies on third-party services (such as Apple, Google Firebase, and RevenueCat) and uses advertising and analytics SDKs (such as Meta and TikTok). Your use of those services may be subject to their own terms. Please also review our Privacy Policy.

11. Termination

We may suspend or terminate your access to the App at any time if you breach these Terms. You may stop using the App at any time by deleting it from your device. Provisions that by their nature should survive termination will survive.

12. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, notify you in the App. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have jurisdiction over any dispute, except where mandatory consumer-protection laws of your country of residence provide otherwise.

14. Apple Standard EULA

To the extent the App is downloaded from the Apple App Store, your use is also subject to Apple's standard Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms conflict with that agreement, the terms more protective of the user will apply with respect to your use via the App Store.
